Consumer Rights
Under federal law, consumers are protected from abusive and deceptive conduct by debt collectors. For example, the Fair Debt Collection Practices Act ("FDCPA") generally requires:
- prohibits harassment (i.e. incessant calling),
- prohibits profane language,
- prohibitis collection calls to place of employment if they are aware that the borrower isn't permitted to receive such calls,
- calling before 9am or after 8pm,
- prohibits discussing the debt with an authorized third-party.
The FDPCA also mandates that certain notices be provided to the consumer. For example, within 5-days of the initial collection communication, the collector must disclose the consumers right to dispute the debt within 30-days.
Although we are making no assertions that Credit Control LLC violates consumer laws, it's important that consumers know they have broad protections from any collector that contacts them with respect to a consumer debt.
If you've received a collection letter, contact our fdcpa lawyers for a free review. If material violations are found, you may be entitled to a statutory award of up to $1000.
